Terms and Conditions

1. Who operates the service

The Kyna service at kyna.cz is operated by Marek Polcar, Company ID 03840131, registered at Keřová 716/5, 641 00 Brno, Czech Republic, e-mail ahoj@kyna.cz (the operator).

2. What you are buying

The subject of the contract is the supply of digital content, that is the image file the service creates for you. You are not buying a printed product or a physical medium. After payment you download the file in your account, where it remains available to you.

The flyer is created by artificial intelligence. Under both Czech and EU law, an image that comes about this way is generally not an authorial work, and so no copyright can arise in it. In practice that means two things. You can use the flyer however you need, nobody has a say in it. And at the same time the law gives you no tool to stop somebody else from copying your flyer. What you buy from me is the file, its delivery, and my undertakings set out below.

To the extent that any intellectual property rights in the flyer do nonetheless arise and belong to me, I grant you a non-exclusive licence to them, unlimited in time and territory.

3. What it costs

The amounts are stated in Czech crowns and are final. The operator is not a VAT payer. You can create previews without limit and free of charge; you pay only for downloading the final file.

4. How the contract is formed and when I deliver

The contract is formed when you pay for the order through the Stripe payment gateway. Delivery is immediate: as soon as the payment goes through, the file becomes available for download and a confirmation is sent to your e-mail address.

5. Withdrawal from the contract

Digital content delivered immediately is subject to a special rule. Before completing the order in the cart you expressly confirm that you want delivery to take place immediately, that is before the fourteen-day withdrawal period expires, and you acknowledge that you thereby lose the right to withdraw from the contract (Section 1837 of the Czech Civil Code). This confirmation is voluntary, but without it the order cannot be completed, because the service cannot be provided in any other way than by immediate delivery.

I keep a record of your confirmation and its time with the order.

6. The Kyna mark and samples of my work

A flyer at the base price carries a small Kyna mark in the corner. You agree not to remove it.

For a flyer with the mark you also grant me a royalty-free licence to use it as a sample of my work, that is to publish it on kyna.cz, on social media and in promotional materials, together with the kennel name and the breed. This licence is the reason the flyer with the mark is cheaper. By granting it you confirm that you are entitled to do so, that is that publication by me specifically is settled with the author of the photographs you uploaded.

For an additional 99 CZK I will deliver a version without the mark. I will not publish that flyer as a sample without your express consent.

You can revoke the licence at any time. Write to ahoj@kyna.cz and I will take the flyer down from the samples.

I undertake not to sell your particular flyer to anyone else. I cannot promise that a similar result will never come about for someone else. The model that creates the flyers is operated by a third party, and that party expressly reserves the right to create similar content for others too.

You undertake not to resell the flyer as a standalone graphic product. This does not apply to your own use to promote your kennel, on the web, on social media or in print.

7. Photographs and third-party rights

By uploading a photograph you declare that you are entitled to use it for this purpose, including its processing into the flyer and including publication of the flyer as a sample of my work under section 6. This matters with images taken by professional photographers, where the copyright usually stays with the photographer even though the dog in the picture is yours. You are responsible for the content you upload.

8. How the flyer is created

The flyer is created by a generative artificial intelligence model from the photographs and details you enter. The result may therefore not be accurate in every detail. Before publishing, please always check the cynological details, that is the names, titles, health clearance results and contacts. You are responsible for the content you publish.

9. Complaints

If the file fails to download, is corrupted or does not match what you chose, write to ahoj@kyna.cz. I will get back to you within three business days and either remove the defect or refund your money. That you do not like the resulting design aesthetically is not in itself a defect; that is exactly why you can create previews without limit and free of charge before paying.

10. Out-of-court dispute resolution

If you are a consumer and we cannot reach an agreement, you have the right to turn to the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 44, 110 00 Praha 1, adr.coi.cz.

11. Changes to these terms

I may update the wording of these terms. Each order is governed by the wording effective at the moment the order is completed. The current version is always on this page and is marked with the effective date at the top.
